Court rejects 34 AR plea, remands personnel to judicial custody

Imphal, July 01 2015 :
An Army jawan of 34 Assam Rifles and a civilian who was his accomplice were sent to jail following a court ruling for 15 days in judicial remand.
The two accused were identified as Abdul Kadir (30) of 34 Assam Rifles and Sabir Khan (24) both of Lilong Chingkham Makha leikai.
They were caught along with guns by a team of Wangoi Police Commando on June 24 and were produced in the court of Alex Muivah, Judicial Magistrate First Class Imphal West on Tuesday.
The counsel from the side of Assam Rifles appealed to the court for the accused Assam Rifles Jawan seeking trial at the court martial.
The counsel moved the plea with justification stating that the arrest time coincides with the time when the commanding officer of 34 Assam Rifles assigned duty to Abdul Kadir.
The plea was supported by written documents from the commandant of 34 Assam Rifles.
Another plea by the counsel of the other accused Sabir stated that he is not involved in any criminal case so far and he was just giving a ride to Abdul Kabir when he met him on his way to buy chicken from the market on the day of arrest.
After hearing the counsels of the accused and the prosecutor, judicial magistrate first class Imphal West 1 court denied bail to Sabir and rejected the plea of conducting the hearing of Abdul Kabir at the court martial.
Both the accused were sent to judicial remand for 15 days.
Mention may also be made that they were apprehended when they tried to flee on seeing a police frisking ahead at Litan bridge.
They were traveling on a pulsar bike.
A 9 mm pistol, one magazine, two live bullets were recovered from them by the police commando team.
Both of them were under police remand since that day and they were produced in the court on Wednesday.
