ADC Member files defamation case against CEO over teacher's transfer

The ADC Member of New Lamka West, CT Lian, has filed a criminal and a defamation case against the Chief Executive Officer, ADC Churachandpur, today, alleging that the official had flouted the warrant of precedecence and harmed the ADC Member's reputation as an elected member for ordering the transfer of a teacher, posted under his jurisdiction, without his knowledge.
Filing the case before the court of CJM Churachandpur today, a legal team of CT Lian claimed that New Lamka Upper Primary School has, ever since his assumption of public office, witnessed many positive changes due to his constant and efficient monitoring and mentoring.
However, an order of the CEO issued on February 5 effectively transferring 10 Assistant teachers, including one from New Lamka Upper Primary School (which falls under his constituency), appeared to have enraged him, as he slapped two serious cases; one for obeying the law with intent to cause legal injury under section 166 of the IPC and another on defamation under section 499 of the IPC.
The four-page long complaint pleaded the court for the accused to be committed in judicial custoday and to prosecute him in accordance with the law; award cost of litigation and pass order or directions that may deem just and proper in the interest of justice.
The legal team further asserted that the CEO had violated the order of precedecence issued by Commissioner GAD, which placed ADC at 34 and that of the CEO at 37, by superseding a Member of District Council and not bringing up the information before him.
