Court remands father and son to judicial custody

Chief Judicial Magistrate, Imphal West today remanded a father and son duo to judicial custody till March 22, for killing their own son/brother.
The accused father Loitongbam Binod (66) s/o (L) Nityai and his son Loitongbam Deepak alias Naoba (30) of Singjamei Okram Leikai, were produced before the Court yesterday from the custody of Singjamei PS along with a prayer for 15 days judicial custody remand.
Meanwhile, the counsel of the accused Deepak filed an objection prayer for releasing him on bail.
The accused father and son duo were charged with causing the death of L Sanajaoba alias Romeo Singh on February 25 (at around 9 pm), by stabbing him with a knife.
The defense counsel of the accused Deepak submitted that he is currently appearing the Class XII examination and is also a sportsman pursuing a career in body building and the FIR was lodged 3 days after the incident.
The defense counsel also submitted that there exist no materials against the accused Deepak and he has been in police custody for a long period and the charges levelled against him are fabricated and prayed for releasing Deepak on bail.
After going through prosecution record, the Court decided that there are enough materials which warrant further investigation against the father, L Binod and remanded him to judicial custody till March 22.However, the Court decided that regarding L Deepak, there are not enough materials to make out the case under section 302 IPC but he also required further investigation and also decided that the submission of the defense counsel, which mentioned that the deceased was a drug addict and was totally drunk on the date of incident, is irrelevant to the charges levelled against the accused.
The Court found no merit in the submission of the defense counsel which mentioned that the case was filed only to victimise the accused persons and decided that it found enough material for further investigation of the case against the L Deepak thus remanding him to judicial custody till March 22.However, as L Deepak was shown to be a candidate appearing the ongoing Class XII examination, the Court directed the SP of Manipur Central Jail Sajiwa to make necessary arrangements for the accused to appear the examination on March 12 and March 26 at his exam centre at Mayang Imphal.
It may be mentioned that the accused individuals were arrested after a complaint was lodged by Loitongbam (0) Sonia (the wife of the deceased) on February 28 at around 11.20 am, before Singjamei PS, stating that her husband died after being stabbed by her father in law and younger brother in law in the courtyard of her maternal home at around 9 pm of February 25.It was alleged that the father in law and brother in law went'into hiding after committing the crime and as such they did not help in rushing the injured victim to RIMS.
It was further claimed that on her way to RIMS hospital, her husband repeatedly told her that the accused individuals had deliberately attempted to kill him.
