Policy on service extension of retired persons under fire

In a significant judgment which will have a wide ramification on the policy of the Government of Manipur regarding service extension or re-engagement of retired persons on substantive posts, High Court of Manipur has quashed the extension of service/reengagement of Dr A Bijoy Singh as the Director of Health Services.
Dr Bijoy retired on superannuation on February 28, 2014 but his service was extended by the Government of Manipur.
The judgment of High Court of Manipur which was passed on September 2, 2014 followed a writ petition filed by Dr K Rajo Singh, Additional Director, and Family Welfare with Advocate Dr Deepak Singh as the petitioner's counsel.
While quashing the service extension or reengagement of Dr A Bijoy Singh as the Director of Health Services, the High Court remarked that such extension/re-engagement of a retired person of a substantive post is against the Fundamental Rule 56(d), which clearly states that 'no Government servant shall be granted extension in service beyond the age of retirement of sixty years.
Moreover, such extension blocks the chances of other qualified incumbents from getting their due promotion.
According to information received by Hueiyen Lanpao, there are a number of such kind of service extensions/ re-engagements of retired persons in various Departments under the Government of Manipur at present and the judgment of the High Court is likely to bearing on them.
