SC disposes special leave petition

The Supreme Court has disposed of the special leave petition filed by BJP candidate of Khundrakpam AC in the 11th State Assembly election by observing that all contentions raised by the petitioner in High Court of Manipur are to be considered by the High Court independently.
The special leave petition was filed by Thangjam Mohendro against Khundrakpam AC MLA Thokchom Lokeshwar challenging the final judgment of High Court of Manipur passed on August 20, 2020 .
The Supreme Court comprising Justice AS Bopanna and Justice Pamidighantam Sri Narasimha heard the submission of counsel appearing for the petitioner and respondent and observed that the order was passed in Election Petition No.3 of 2017 dated August 20 .
It is a common ground that the term of the House which was subsisting as on the date when the order was passed has come to an end and the elections having been subsequently held, the House has been constituted afresh in April, 2022, the Court observed and added that the respondent has been re-elected to the House while the petitioner is stated to have initiated a fresh election petition which is pending before the High Court of Manipur.
The apex Court further said that all contentions which are being brought up by the petitioner are to be considered by the High Court independently.
Mention may be made that the election petition of Thangjam Mohendro was dismissed by the Single Bench of the High Court of Manipur on August 20, 2020 .
