High Court quashes Govt order on recruitment of 1,423 Primary teachers

High Court of Manipur on Tuesday quashed the order issued by the State Government for recruitment of 1,423 Primary Teachers in 2011 .
The court has directed the State respondents and in particular, the respondent numbers 1, 2 and 4 to instruct the Review DPC to submit a fresh recommendation strictly in accordance with the notice dated September 12, 2006 within a period of two months from the date of receipt of a copy of the judgment and order.
The respondent numbers 1, 2 and 4 are State of Manipur through the Chief Secretary, the Commissioner/Secretary, Education (S) and the Director of Education (S) .
The court order said that the recommendation shall include the lists of candidates belonging to unreserved, ST, and SC only and not OBC at all.
On receipt of such a recommendation from the Review DPC within two months as mentioned, the State respondents and in particular, the respondent numbers 1, 2 and 4 shall issue a notification declaring the result and issue appointment orders within a month thereafter, the High Court said.
The court said that keeping in mind the interest of the students, the incumbent Primary Teachers shall be allowed to continue in service in their respective positions for three months from the date of receipt of a copy of this judgment and order.
In the meantime, the court said, the State respondent numbers 1,2 and 4 shall complete the whole exercise .
The present writ petition has been filed in the court challenging the legality and validity of the entire recruitment process including the impugned notification dated September 4, 2011 and its subsequent appointment order dated December 9, 2011 with a further prayer to direct the official respondents to hold the aforesaid recruitment process afresh within a stipulated period.
