The Chief Judicial Magistrate has kept his verdict reserved on the application filed by the Army Court of Inquiry requesting the Court to direct the OC of Irilbung PS to appear before it along with the DNA profile of the semen stain found on the under garments of Th Manorama.
After hearing a prolonged argument, the CJM, Padmeshore, kept his verdict reserved for the day.
Sources said that the ruling may be issued tomorrow.
Deputy Judge Advocate of the Army, Colonel Trivedi Prasad and a Central Govt Standing Counsel appeared on behalf of the Army Court of Inquiry while Additional Public Prosecutor P Ibomcha appeared for the State of Manipur.
Ibomcha argued that the Court of the CJM does not have the jurisdiction to direct the investigating officer to produce the documents (DNA profile and other related matters) before the Army Court.
The forensic examination of Manorama's under garments and the test of the vaginal swab of Manorama was initiated by the State authority and not by the Court, Ibomcha argued.
Earlier the Army Court had tried to lay its hands on the DNA profile from various Government agencies and officers, said sources.
Meanwhile the State Government is ready to file a counter-affidavit to the petitions filed by Army against the ongoing State sponsored Thangjam Manorama Death Inquiry Commission, headed by retired Justice C Upendra.
The matter will be heard at the Principal seat of the Gauhati High Court on September 28.
