The State Government has ordered the removal of the incumbent Chairman of Tamenglong ADC Namsinrei Panmei with immediate effect.
It further ordered that a new Chairman of the ADC shall be elected immediately under the provisions of the Manipur (Hill Areas) District Council Act, 1971.An order to this effect was issued by Principal Secretary, Tribal Affairs & Hills Department on January 31 .
According to the order, the Deputy Commissioner, Tamenglong submitted to the Government the proceedings of the meeting of the members of the Tamenglong ADC held on January 15 to consider a resolution for removal of its incumbent Chairman.
In the meeting, a total of 14 Members including two nominated Members voted in favour of the resolution for removal of the Chairman.
The resolution for removal of the Chairman having been passed by a simple majority of the total membership of the ADC, including the nominated Members, the DC submitted the matter to the Government for decision in terms of sub-section (2) of section 23 of the Manipur (Hill Areas) District Councils Act, 1971 .
The Ld Advocate General has given his advice and opinion that since the resolution for removal of the Chairman had been passed by a majority of the total membership of the ADC and that the order passed by the High Court came to the knowledge of the DC only after the completion of the proceedings of the meeting of the ADC, the State Government is at liberty to take a decision as provided under section 23(2) of the Manipur (Hill Areas) District Councils Act, 1971 for removal of the Chairman and further action for election of a new Chairman of the ADC, it stated.
It is considered in the interest of smooth functioning of the Tamenglong ADC to remove its incumbent Chairman and pave the way for election of a new Chairman, the order stated.
