HC annuals recruitment of SSA teachers

The notification for recruitment of Primary teachers under Sarva Shiksha Abhiyan (SSA) issued by the Manipur Government on February 28, 2012 has been declared null and void by an order of the Gauhati High Court.
The order of the Gauhati High Court further instructs the State Government to issue a fresh notification for recruitment of 1952 Primary teachers within seven days and also to form a Selection Committee and complete the selection process by March 31 next.
The order was passed by a Division Bench of Gauhati High Court, Principal Seat, comprising Justice T Vaiphei and Justice S Talpatra yesterday over a stay order whose hearing was done on August 25, 2010 .
According to the 80-page judgment of the division bench, the State respondents have been directed to publish a fresh recruitment advertisement for the candidates who were qualified as on 28-10-2011 in terms of the principal notification dated 23-08-2010 as published in the gazette of India dated 23-08-2010 and the amendment notification dated 15-08-2010 as published in the Gazette of India dated 29-07-2011 for filling up of the vacancies to the extent of 1951 posts as notified by the notification dated 18-10-2011 within seven days from yesterday.
The judgment further instructs the State Government to complete the selection process within 15 days from the date of passing the order.
However, those candidates who have applied earlier need not apply anew.
A selection Committee is also to be formed and the process of selection is to be completed by March 31 next.
The comparative merits of the candidates shall be assessed by a scientific and transparent method.
The persons having the minimum qualifications in terms of the Principal notification dated 25-08-2001 as published in the Gazette of India dated 25-08-2010 should form a category in terms of merits and the vacancies shall initially be filled up from the candidates of the said category and thereafter the candidates from the relaxed qualifications shall be accommodated against the remainder of the vacancies in order of merit, subject to the reservation policy, the judgment added.
In the hearing of the Gauhati High Court, Principal Seat, the counsel of petitioner Tayenjam Herojit and 55 others stated that a notification for the recruitment of 1951 Primary teachers was issued on October 18, 2011.Later the results of the Primary teachers and upper Primary teachers recruited under SSA along with the waiting list were declared on February 28, 2012.However, since the recruitment rules have been totally sidelined in the process of the recruitment, the counsel asked for annulment of both the notifications.
