SE demoted post retirement ?

An engineer of PHED who worked as a Superintending Engineer (SE) before retire-ment is facing a bizarre situation where he maybe demoted to the rank of Executive Engineer (EE) .
After Haobam Sunil was promoted to the post of Additional Chief Engineer, one post of SE was lying vacant at PHED since January 1, 2014 .
A list of five EEs namely Ph Yaima, Th Lokeshore, H Bigadhon, Ningainung Lungleng and RK Premi was submitted to the MPSC for selection of one of them to the vacant post through DPC.
Accordingly, a DPC meeting was held on April 1, 2014 but the same process could not be completed due to incomplete documents submitted by the department.
On the next day, MPSC sent a letter to the Principal Secretary (PHED) to re-examine the incomplete documents and re-submit a complete set of documents.
Even as the letter sent to the Principal Secretary did not point out incomplete or missing sections of the documents submitted, another letter written by Joint Secretary (PHED) to the PHED Chief Engineer on April 7, 2014 pointed out that there were errors in the ACRs of a few EEs .
Subsequently, rectified/modified ACRs of Ph Yaima, Th Lokeshore, H Bigadhon and Ningainung Lungleng were submitted to the Principal Secretary (PHED).
This was followed by another letter to MPSC which sought a second DPC for requisitioning one of the EEs to the vacant post of SE.
However, Ph Yaima was removed from the list of probable candidates for the vacant SE post and he was replaced by N Gambhir.
MPSC fixed March 17, 2015 for the second DPC meeting.
In the meantime, RK Premi filed a petition at the High Court of Manipur on March 16, 2015 contending that holding DPC based on modified ACRs was violation of relevant rules.
Despite the petition, the DPC was held and MPSC recommended Th Lokeshore to the vacant post of SE.
The Under Secretary (DP) issued an order on the day the DPC was held whereby Th Lokeshore was appointed as SE.
After working for around one year as SE, Th Lokeshore retired from service on February 29 last year.
On the other hand, Advocate Th Babita appeared on behalf of RK Premi at the High Court of Manipur regarding the petition filed by the latter.
The High Court passed a judgement on April 28 this year which directed the authority concerned that the DPC held earlier should be declared null and void and a fresh DPC should be held.
Given this order of the High Court, it is not yet clear whether retired Th Lokeshore's rank should be counted as SE or EE.
