Manorama's mother seeks CBI inquiry

With the state government failing to take action even as Guahati High Court had given the state government liberty to deal with the recommendations made by One-man Inquiry Commission constituted against the alleged rape and murder of Thangjam Manorama by Assam Rifles personnel in 2004, Manorama's mother has petitioned Gauhati High Court praying for a directive to the state government to hand over the case to the CBI.
Mention may made that the state government has not been able to act on the filing of different writ petitions by the Assam Rifles, the state government and family members of Manorama.
A division bench of Gauhati High Court, Principal Bench comprising of Justice Amitava Roy and Justice BD Agarwal had announced its judgment and order on August 31, 2010 which was reserved after the hearing at length held on May 11, 12 and 13 of this year in Guwahati.
The ruling of the court had given Manipur government liberty to deal with the provisions of the Commission of Inquiry Act, 1952 and other relevant provisions of law pertaining thereto.
Manorama's mother, Thangjam Ongbi Khumanleimai filed the writ petition to the Guahati High Court, Imphal Bench with the backing of the Human Rights Law Network, Manipur.
The respondents of the case are state Home Department, DGP, Union Defence Ministry, IGAR (S) and 17 Assam Rifles.
In her petition, Khumanleima alleged that even though six months have passed since the high court gave the state government liberty to implement the recommendation of the inquiry commission no action has been taken up so far.
She also prayed the court to direct the state government to disclose the finding and recommendations of the inquiry commission, to award befitting punishment to the errant AR personnel after an investigation be handed over to CBI.
