Woman sentenced for murdering own bro after 20 yrs

In one of the rarest cases of its kind in the State, a woman has been sentenced to five years rigorous imprisonment along with a fine of Rs 10,000 for stabbing to death her own elder brother with a kitchen knife by a court after 20 years of committing the crime.
An order to this effect was passed by M Manoj Kumar, Additional Session Judge, Manipur East, yesterday.
According to reports received by Hueiyen Lanpao, the woman identified as Lourembam Usharani Devi, d/o L Gourakishore of Thangmeiband Yumnam Leikai has been convicted under section 304 Part II of IPC for murdering her own brother L Bishworjit Singh on November 24, 1992 at her courtyard.
According to the judgment passed by Additional Session Judge, Manipur East, the convict has been sentenced to rigorous imprisonment for 5 years and imposed a pay a fine of Rs 10,000.In case of default in payment of the fine, the accused would have to undergo imprisonment for one more year.
The period of 4 months and one day, which the convict had already spend in judicial custody during investigation shall be deducted from the imprisonment period.
The said fine of Rs 10000 is to be deposited to the Court within 3 months from March 8, 2013 and the amount, if paid, is to be given to the surviving widow/daughter or legal heir of the deceased.
During the hearing of the case, the learned counsel of the accused contended that the incident took place while Usharani was just 19 years old (now 39 years old) and she was provoked by the fighting between her elder brother and younger brother.
The counsel also observed that there is no criminal antecedent of the accused prior to the said incident as well as during the course of proceeding in the last 20 years.
After hearing the counsel of the accused, the Court maintained that there is no ground for releasing the accused under Probation of Offenders Act and section 360 of CrPc.
Moreover, there is no ground for awarding sentence for the period she had already spent while in judicial custody during the course of investigation.
Kh Bimola, Additional Public Prosecutor and Advocate Mani Sharma fought in favour of the State and the accused respectively.
