High Court passes interim order regarding appointment of JNIMS Director

The High Court of Manipur has passed an interim order on January 4 regarding appointment of JNIMS Director.
The interim order was passed by a single bench of the High Court of Manipur comprising Justice N Kotiswar after a writ petition was filed by Dr L Usharani Devi, Professor, Dept of Community Medicine, JNIMS against the State of Manipur and four others challenging the eligibility of Dr L Deben (respondent no 4) as JNIMS Director.
The writ petition was listed on January 4 before the single bench under writ petition (civil) case number 12 of 2017 .
The petitioner challenged the appointment of Dr L Deben to the post of JNIMS Director on the ground that he did not possess the requisite qualification as per the relevant service law which required that a person must have 10 years of teaching experience as a Professor/Associate Professor/ Reader of a medical college/institution out of which he or she should be a Professor in a department at least for 5 years.
The writ petition also mentioned that the petitioner was appointed as Professor of Community Medicine by an order issued on issued on December 17, 2011, on temporary basis.
After regularisation, she is presently serving as HoD of the same Department.
Advertisement for appointment of JNIMS Director (contract) was published/issued on November 11 last year by the Director in charge.
The interview/viva-voice for appointment to the post of JNIMS Director was contemplated to be held on January 5.The present Director in-charge of JNIMS too applied for the same post.
On enquiry, it was learned that the Director in-charge was not qualified for the post of JNIMS Director.
After hearing the writ petition, the Court passed an interim order returnable within four days which ruled that the interview for appointment of JNIMS Director may proceed and if the respondent no 4 is recommended, his appointment as JNIMS Director should remain provisional and it would be subject to the result of the writ petition.
The Court listed the petition for next hearing on February 8 .
