14 days remand for RK Meghen, handcuffs off

Along with producing chairman of the proscribed UNLF RK Meghen alias Sanayaima in a special court of National Investigation Agency (NIA) at Guwahati at around 1 pm today, the rebel leader has been remanded to judicial custody for another 14 days.
RK Meghen is to be produced again in the special NIA court to be presided by judge AK Das on January 11, 2011.For the first time after his arrest, RK Meghen was produced before the court without any handcuff today.

It may be noted here that acting on a petition filed by M Gunadhor, the lawyer of RK Meghen, the NIA special court had directed the authority of Guwahati Central Jail as well as the police not to handcuff RK Meghen at the time of bringing him to the Court and taking him back to the jail.
Quoting other relevant judgements passed by the Supreme Court, M Gunadhor has contended in his petition that RK Meghen is not a criminal nor has he committed any crime.
So, he should not be handcuffed like a criminal.
When the court sought their opinion on the contention, Guwahati police asserted that handcuffing of RK Meghen is necessary in the light of intelligence report that UNLF cadres based in Guwahati may attempt to rescue him.
In the hearing of the petition, special judge AK Das of NIA court ruled that ' it appears that the said report does not disclose any concrete proof regarding the proneness of the said to UTP to violence, his tendency to escape and any proof of involving in dangerous and desperate activities and the said report has also failed to disclose any data based information including reasonable expectation of exposing any violence with tendency to escape'' .
