Charge sheet filed against 3 more cops

Chief Judicial Magistrate Imphal East, has fixed June 10 for taking cognizance of charges levelled against three police personnel against whom CBI/ SIT recently submitted charge sheet in connection with the alleged extrajudicial killing of one Ningthoujam Khaiba on November 13, 2006.The charge sheet was submitted against five accused police personnel initially before the Court for taking cognizance, by the 10 of the case, DSP, B Ranjan Roy, CBI/SCB Kolkata, a few days back, but two of the five cops, identified as then Constable Th Lungdim and then Constable Pashel Angson Anal had already expired.
The three other remaining accused police personnel include then Havildar Khundongbam Inaobi S/o Kullo of Yairipok, then Head Constable Thounaojam Herojit s/o Shyamsunder of Lamdeng Awang Leikai and then Constable Longj am Chingkheihunba s/o (L) Yaima of Keishamthong Longj am Leirak.
The charge sheet mentioned that, CBI/SIT had started investigation in connection with the death of Ningthoujam Khaiba on the basis of the complaint filed by one of the accused police personnel before Lamlai PS and as per the report, the incident occurred when the victim tried to snatch the service weapon of the accused Th Herojit when he (Khaiba) was being detained by a commando team On the other hand, according to the family members who were present along with the victim at the time of the incident, claimed that after the incident, 5 of them were forced to board a Maruti van and taken to the commando complex and kept blindfolded for around 30 minutes.
The charge sheet informed that the post mortem report suggested the bullets were fired from multiple directions from a close range.
The charge sheet explained that the theory of the accused commando personnel is taken on face value and as per the report, the deceased had tried to snatched his service weapon and as such he was shot to death, which comes under excessive use of force specially when five trained commando personnel had the opportunity to overpower the deceased person.
The charge sheet further mentioned that the commando personnel also created a false story to screen themselves from the offence and added that as per the fact, evidence and circumstances, the charge sheet against the 5 police commando personnel are liable for prosecution.
Thus CBI/SIT prayed for taking cognizance of offence against the accused commando personnel and to issue necessary notices against them.
The CBI/SIT also submitted that prosecution sanction against the accused commando personnel is awaited and will be submitted to the Court, when received from the competent authority.
It may be mentioned that Chief Judicial Magistrate, Imphal West recently allowed CBI to seize the 9 mm pistol along with magazine involved in the alleged fake encounter of N Khaiba, which was issued to then Head Constable Th Herojit and which had been in the custody of City police Malkhana in connection with the ongoing trial of My 23 BT road firing incident.
It may also be mentioned that the deceased Ningthoujam Khaiba alias Binoy of Keirenphabi, was reportedly gunned down by Imphal West commando on November 13, 2006 a few hours after he was released from Sajiwa Central Jail.
At that time, his family members alleged that a team of commando personnel stopped the vehicle in which Khaiba, his father, brother and an Advocate, were aboard, on their way home and the commando personnel shot dead Khaiba on spot after pulling him down from the vehicle.
Ningthoujam Khaiba, had been released on that day after he was detained under NSA since he was arrested by police from near Oinam Dam, Mayai Lambi in October 2005 .
