One charged for murder attempt

The Session Judge, Imphal West on Tuesday framed charges against one Nelson Nameirakpam under Section 307 for allegedly attempting to murder one Roshan Thounaojam at the Horizon Printing Shop, Lamphel Supermarket on March 17 last.
The charges were framed after hearing different charges levelled by the IO against the accused.
A case was registered against the accused based on a complaint lodged by one P Xmar (24) of Mao Pundung Tadubi, presently residing at Langol Housing Complex on March 17 .
According to the complaint, Roshan Thounaojam (32) s/o Th Parasmani of Thangal Bazar was dropped in at Horizon Printing Shop owned by Nelson Nameirakpam (33), s/o Noren of Singjamei Chingamakha Yanglem Leikai on the same day (March 17).The complainant claimed that he and one Hongching waited for Roshan inside a car when they saw Roshan dragging the accused towards the car.
At that time, Roshan was covered with blood and the bleeding was suspected to have been caused by the accused using a sharp object.
As Roshan sustained injuries on his neck (right mid line), he was admitted to Little Clinic, as per the complainant.
An FIR was registered at Lamphel police station and the accused was arrested on March 18, 2021.One cutter was reportedly seized from the accused.
It is stated that the victim lent money to the accused and the latter assured of returning the amount with interest of 4 per cent per month.
The IO of the case after completion of the investigation submitted a chargesheet against the accused before the CJM Imphal West for taking up cognizance of the offences under Section 326/307/201 IPC.
The Court heard Additional PP and defense counsel for the accused and perused all the materials on records.
The Additional PP submitted that sufficient materials exist for framing charges against the accused.
The injury report indicated grievous injury caused by sharp weapon and the alleged attacked was an attempt to murder.
The accused also removed the video footage of the CCTV camera installed at the place of occurrence.
The Court observed that the prosecution must show prima facie that it was the accused who removed the evidence.
However, the report issued by NIELIT, Imphal, Cyber Forensic Lab on March 25 last said the "recorded clip of all the four channels are missing and cannot be recovered and there is no evidence to prove that the accused deleted the evidence.
Hence, the prosecution failed to show prima facie that the accused committed the offence under Section 201 IPC.
Nonetheless, the Court observed that the materials on record are sufficient to frame charges against the accused under IPC Sections 326 and 307 and thus charges were framed
against Nelson Nameirakpam.
