One convicted for rape and cheating

Binny Ngangom, Additional Session Judge, Fast Track Court Crime against Women Manipur, convicted a 40 year old individual identified as Konsam Poirei alias Inaoton 40 s/o Lukhoi of Charangpat Maning Leikai for cheating and raping a victim on September 17, 2009.The judgment was announced in an open Court today after it was kept reserved from March 7 following the final hearing of the case.
The Court also fixed May 13 for the sentence hearing against the convict.
The convict, who had been on bail in connection with the case, appeared before the Court along with his defense counsels Advocate Picha Singh and Advocate AK Somorendro today.
The case began against the convict after a written complaint was lodged by the victim of the case stating that on September 17, 2009, she had eloped with the convict who pretended to be a divorcee having no wife or children.
Later on it was learnt that the convict had a legal wife and children as well and she had been wrongfully enticed to establish physical relationship with the convict.
Sub Inspector Ali Hasan, the IO of the case, submitted the charge sheet against the convict on June 6, 2012, before the Court of Chief Judicial Magistrate Imphal West.
During the trial, 7 prosecution and 2 defense witnesses were examined by the Court and the argument hearing began from January 3 this year.
During the hearing, Special PP Sushila Devi for the State, submitted that the convict cheated and raped the victim by posing himself as a divorcee having no wife and children.
On the other hand, the defense counsel of the convict submitted that there is no evidence on record that the convict had raped the victim after cheating her and pointed out that the case has been filed by the victim against the convict after being instigated by her (victim) parents.
The defense counsel further submitted that the victim knew that the convict had separated from his wife at the time of the incident and that he was living with his children only.
The Court heard both parties and went through the records before convicting Konsam Poirei under section 417 and 376 IPC ( cheating and rape) .
