Hand over case record to CBI: Court

Chief Judicial Magistrate Imphal West has allowed all case records in possession of the Court to be handed over to the 10 of the case (after keeping the copies of the said record) for purpose of investigation of the FIR case taken up by the CBI/ SIT in connection with the alleged fake encounter cases of Manipur.
The application was filed by PK Roy, PI/CBI/SC III New Delhi Camp, Imphal, the IO of the case, as petitioner against NB Thakuri Naik, Subedar, Head Quarters, 9 Sector, 57 Mountain Division, C/o 99 APO and some unknown personnel of Assam Rifles, in connection with the death of one Kangujam Ojit in the year 1997.The Court heard and went through the application filed by the 10 which submitted that as per the direction of Supreme Court of India to the CBI to look into the alleged fake encounter cases and use of excessive or retaliatory force in Manipur, a case was re-registered by CBI/SIT.
With respect to the death of Kangujam Ojit Singh, a case was earlier registered at Lamphel PS, under FIR number 39 (3) 1007 Lamphel PS, under section 302 and 34 IPC, which was then transferred to SP, CID, Crime Branch Imphal, who later submitted a final report on July 17, 2002.With the re-registration of the FIR by CBI/SIT, all the case record and any other case properties became necessary for the investigation of the case and hence the application prayer was filed.
After the hearing the prayer, the Court expressed satisfaction with the prayer of the 10, CBI/ SIT and thus allowed the prayer.
The Court ordered all the case record in respect of the case which are in possession of the Court to be handed over to the IO after keeping the copies of the said record, for purpose of investigation of the registered FIR case.
According to the records available with The Sangai Express, the deceased was allegedly arrested by personnel of 9 Sector, 57 Mountain Division, on February 16, 1997 and was handed over to Lamphel PS after three days.
He was admitted to then JN Hospital, Porompat and later died on February 20, 1997 .
