Non appointment of regular principals : Legal tangle cited for post backlog

Citing a writ petition referred to the High Court of Manipur by the Supreme Court, Deputy Secretary (Higher and Technical Education) Y Dhimbajit has stated that appointment of regular Principals of Government colleges would be sub-judice until the case is decided by the High Court.
The State Government would take appropriate action as per the final decision of the high Court as it not possible for the State Government or Manipur Public Service Commission (MPSC) to proceed with the recruitment process until the High Court of Manipur decides the case, informed a press release issued by the Deputy Secretary.
The Department of Higher Education, Government of Manipur sent a formal proposal to MPSC on June 19, 2013 for recruitment of 25 posts of Government College Principals on regular basis.
In response, MPSC issued recruitment advertisement on August 27, 2012 calling for applications from the eligible candidates for the said post indicating essential qualifications prescribed by UGC Regulations, 2010 .
The candidates were notified to collect their admit cards on February 1, 2014 and interview was scheduled on February 17 .
On February 5, MPSC published a list of 49 screened candidates giving the terms and conditions and eligibility under minimum API score screening to be done by Department of Higher Education.
The Government constituted a screening committee with API expert from UGC on the same day and committee completed API score screening on February 11 .
Even as interview was already fixed on February 17, a special leave petition was filed at the Supreme Court by one Dr RK Yaiskul and others on February 14, 2014 challenging the judgement of the High Court of Manipur dated December 4, 2013 .
The Supreme Court issued an interim order and stayed the process of holding interview.
After taking final hearing on April 22, the Supreme Court referred back the case to the High Court of Manipur for deciding the writ petition afresh and to dispose off the case on merit preferably within two months.
Thus it would be sub-judice to go ahead with the interview until the High Court of Manipur decides the case, the Dy Secretary clarified.
