HC asks OC to examine complaint

A Division Bench of High Court of Manipur has directed the OC of Porompat police station to examine the complaint/report given by Sapam Robinhood's father to find out whether any cognizable offence is disclosed in the said report.
The Court further directed the police officer to act accordingly under Section 154 of CrPC if there is any cognizable offence.
Speaking to reporters at a press conference, senior advocate Khaidem Mani said that the directive came after Robinhood's father Romesh filed a writ petition at the High Court complaining that his report was not accepted by the police station.
It may be mentioned that Sapam Robinhood, a Class XI student of Ananda Singh Higher Secondary Academy, died in police action during a pro-ILPS agitation on July 8 last.
After the incident, instead of filing an FIR based on the complaint lodged by Romesh and JAC, the police station took up a suo moto case in connection with the incident.
Romesh filed his writ petition at the High Court on July 16 for which the hearing was conducted before a Division Bench of Justice Laxmi Kanta Mohapatra and Justice N Kotiswar Singh on November 26 .
Petitioner's counsel Khaidem Mani said that in his writ petition, Romesh pleaded the Court to direct Porompat police station to accept his report/complaint and file an FIR to investigate the circumstances that led to his son's death.
Romesh also requested the Court to direct CBI to investigate the incident.
The respondents of the writ petition are the State of Manipur through Principal Secretary (Home), Government of Manipur, DGP Manipur, Imphal East SP and OC of Porompat police station, Khaidem Mani said.
During the hearing of the writ petition, learned Senior Government Advocate from the side of respondents told the Court that registering an FIR at this stage would amount to running two parallel investigations as a Judicial enquiry is being conducted to probe the incident.
