Imphal, May 27 2015 :
Under the 10th Schedule of the Indian Constitution, the Speaker's Tribunal Court of Manipur Legislative Assembly has disqualified Thangmeiband AC MLA Khumukcham Joykishan, Wangoi AC MLA Oinam Lukhoi and Thongju AC MLA Thongam Biswajit as the members of the tenth Manipur Legislative Assembly today.
The Assembly Secretariat issued a bulletin to this effect today.
Strict security measures were taken up at the Assembly complex when the ruling was issued today.
The bulletin said that it was found that the MLAs have manifestly expressed their intention to give up membership of their original political party - AITC and its State unit MPTCC.
|
Their intention was confirmed by their actions of forming a new political party called AITC, Manipur State, which has a separate Constitution and its State political party was called MPTC, the bulletin said.
All of them were elected to the tenth Manipur Legislative Assembly election on All India Trinamool Congress ticket along with Th Shyamkumar (Andro AC), K Sarat (Konthoujam AC), Dr I Ibohalbi (Oinam AC) and (L) Maibam Kunjo (Hiyanglam AC).
However, after the said election, AITC MLAs excluding Th Shyamkumar and Dr I Ibohalbi defected from their parent party and formed Manipur Pradesh Trinamool Congress (MPTC) with Kh Joykishan as the president.
Opposing the said move of the five MLAs AITC Manipur Unit president Th Shyamkumar and other individuals lodged complaints against them at the Tribunal Court of the Legislative Assembly seeking their disqualification as MLAs under the 10th Schedule of the Indian Constitution.
Soon after the formation of MPTC and lodging complaints against the five MLAs, different allegations were made from either side.
Later, after receiving 16 different complaints on the same issue, the Speaker's Tribunal Court began hearings of these cases from July 31, 2014 .
After the Tribunal Court reserved the order of the case number 2, 3, 4 and 6 involving these three MLAs for some time, the final disqualification verdict was announced today leaving these seats vacant.
Five other disqualification cases are still pending in the Court of the Speaker's Tribunal.
Final hearing of the disqualification case of MLA K Sarat will be held on June 6 .
