On MHA notification about Assam Rifles

Youth’s Forum for Protection of Human Rights (YFPHR) regret to learn the news of the notification which was issued by the MHA mentioning that
“Assam Rifles personnel will exercise these powers and discharge their duties “under sub-section(1) of section 41, sections 47, 48, 49, 51, 53, 54, 149, 150, 151 and 152 of the CrPC within the local limits of the area comprised within the border districts of Assam, Arunachal Pradesh, Manipur, Nagaland and Mizoram”.
It could be learned that Section 41 of the CrPC states that a police officer without a warrant may arrest a person.
Section 47 gives powers for search of place entered by person sought to be arrested.
Section 48 gives the police officer the power to pursue an offender into other jurisdictions.
Section 49 states that the person arrested shall not be subjected to more restraint than is necessary to prevent his escape.
Learning from the fact it is clear that the right to life of people living in the North East region is suspended by empowering the Para military to act upon thier wish.
It is not surprising to experience an act of the CentralGovernment by issuing a notification as the Government of India still fails to revoke the draconian law AFSPA 1958 beside many oppositions internationally.
We would like to inform the GOI that We cannot experience more fake-encounter in our state as thousands of case are still pending in Supreme Court which should not be bypassed.
Our humble appeal to the Government of India is to respect its own constitution and act accordingly and also to uphold the largest democratic country in the world.
