Draft Trafficking of Persons (Prevention, Protection and Rehabilitation) Bill 2016

The Manipur Commission for Protection of Child Rights (MCPCR) convened a special discussion today the 28th June, 2016 and analysed the Draft Trafficking of Persons (Prevention, Protection and Rehabilitation) Bill 2016 as prepared by the Ministry of Women and Child Development, Govt. of India in the context of trafficked victim children pertaining to prevention, rescue, repatriation and rehabilitation. Members & Consultants of MCPCR and representatives of CHILD RIGHTS AND YOU (CRY, Kolkata) & Manipur Alliance for Child Rights took part in the discussion.
Important points resolved to recommend to the concerned WCD Ministry to make certain changes in the proposed Draft Bill, among others were:
1. A comprehensive Definition of human trafficking with details of different forms of human trafficking should be included.
2. Representatives from Police Department & Child Welfare Committees should be incorporated into the proposed District Anti-Trafficking Committee.
3. Representatives from Finance and Education Department should be in the State Anti-Trafficking Committee.
4. Unregistered Placement Agencies to the proposed Act and should not be allowed to put their commercial advertisements on newspapers that may lure specially the children and young people in mass media, contravening of it should be penalised not only the unregistered agencies/firms but also the media house which published the unproven news, which may lead to human trafficking.
5. In case of trafficked victim is a minor, then the repatriation and restoration process should be taken up as per the provisions of Juvenile Justice (Care and Protection of Children) Act, 2015.
6. Provision of mandatory reporting, mandatory recording by Police for Child Trafficking cases should be incorporated following the provisions of The Protection of Children from Sexual Offences (POCSO) Act, 2012 and JJ Act 2015. And there must be specific timeframe for investigation, charge sheeting and trail for the Child Trafficking cases similar with child sexual abuse cases as mandated in POCSO Act 2012.
