Rights activists say that the Act is the main cause of countless instances of human rights abuse and extra-judicial killings in the Northeast and Jammu and Kashmir, the only two regions in the country where the Act is in force. The allegations are pertinent in a recent judgement of the Gauhati High Court which ordered an Army official to appear at a Sivasagar court to stand trial in an a lleged case of murder of a youth.
The Army official — a major presently attached to Northern Command — is accused of being involved in the unnatural death of the civilian, who was physically assaulted by Army personnel at Geleki in Sivasagar district in 2004.
Despite being named as an accused by police and issued summons, the Army official had sought protection under the AFSPA. He had claimed that as he was working under the AFSPA at that time, the Act gave him immunity from prosecution.
