Court orders judicial inquiry into Nanao's death

Imphal, May 05 2022: CJM Imphal West on Thursday ordered a judicial inquiry into the death of Arambam Nanao, who reportedly died after he was arrested by police on May 2 .

Arambam Kombirei, mother of deceased, had filed a petition mentioning the State of Manipur and Officer in-charge, Imphal PS as respondents.

The hearing of the petition was held on Thursday.

During the hearing, Judicial Magistrate First Class Imphal West-II Robert Lhungdim ordered a judicial inquiry into the alleged custodial death of Arambam Nanao and directed that the report on the same be submitted to the Court within two weeks.

According to the order, the judicial inquiry should cover the cause of death, the circumstances surrounding Nanao's death, the motive and goal behind his death, whether any person or police personnel was involved in Nanao s death, any lapses in the rescue efforts made by the police personnel to save Nanao's life, and whether the police personnel obtained any monetary or material gains from Nanao or his family.

The magistrate further ordered for verifying the inquest and post mortem report; record of Nanao's arrest in the general diary of the police station concerned or FIR or any related documents; whether the police office informed the control room of Nanao's arrest within 12 hours, as per a Supreme Court ruling; total number of personnel on regular or temporary posting in Imphal PS including VDF and home guards; roster duty of the PS on the day before and after the incident; identity of the inmates who stayed in the same lockup with Nanao on May 2; weapons/materials with the fingerprints of the accused, used in torturing Nanao; along with verification of the family and relatives of the deceased, eyewitnesses, doctors of RIMS Emergency Ward, independent witnesses and other people concerned.

The Court also ordered that all officers and personnel presently posted at Imphal PS cannot be transferred until the judicial inquiry is completed, so as to be of further assistance to the inquiry.

Additionally, the body cannot be disposed until the inquiry is completed.

All authorities concerned should extend all necessary assistance to the conduct of the judicial inquiry.
